INSPECTION DETAILS AND ADDITIONAL TERMS

It is the duty of the respective buyer to research these assets to their satisfaction prior to bidding. The assets are sold with no warranties expressed or implied. It is the duty of prospective buyers to do their research to their satisfaction prior to bidding, and a bid shall constitute a binding contract, in which the buyer is agreeing to abide by the Terms of the Auction. USA Management Corporation (“Seller”) is a Third Party Beneficiary to the Bid4Assets Terms of Service (pursuant to paragraph 3.3(f), as amended from time to time), and your bidding on this auction is your further agreement: (i) that the auction is governed by and construed in accordance with the laws specified in the Bid4Assets Terms of Service (Section 5.10, as amended from time to time), that you will submit to that jurisdiction, and that jurisdiction is the only place a legal action may take place; (ii) that Seller may take any legal action to enforce the contract between the Bidder and Seller; (iii) that you, the Bidder, will be responsible for all costs and expenses, (including legal expenses and court costs) in enforcing the agreement; and (iv) that notwithstanding any limitations of liability between the Bidder and Bid4Assets, you agree to these Additional Terms of Service.
